McCoy dA <br />Staff Planner, Current Development <br />DATE: April 18, 1990 <br />SUBJECT: HIGH PINES SUBDIVISION DEVELOPER'S REQUEST FOR SPECIAL <br />EXCEPTION APPROVAL FOR A SAND MINE AT 65TH STREET AND <br />58TH AVENUE <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of May 1, 1990. <br />PROPOSED DEVELOPMENT AND LOCATION: <br />McQueen and Associates, Inc, on_behalf of the High Pines subdivi- <br />sion developer, has submitted a concurrent request to receive <br />minor site plan and special exception approval for a sand mining <br />operation to be located at the south corner of 58th Avenue and <br />65th Street. <br />The subject property is zoned RS -6 and requires a special excep- <br />tion permit for a sand mine. Special exception uses are those <br />types of uses that would not generally be appropriate throughout a <br />particular zoning district. However, when special exception uses <br />are carefully controlled as to number, area, location, and/or <br />relationship to the vicinity, such uses would not adversely impact <br />the public health, safety, comfort, good order, appearance, <br />convenience, morals and general welfare and as such would be_ <br />compatible with permitted uses within the particular zoning <br />district. In granting any special exception, the Board may <br />prescribe appropriate special conditions and safeguards to ensure <br />that the use is compatible with surrounding uses. <br />The proposed mining operation is to be in conjunction with the <br />excavation of a lake which is to be incorporated into the High <br />Pines subdivision. The subdivision received preliminary plat <br />approval from the Planning and Zoning Commission at its December <br />14, 1989 meeting (see attachment #4). The applicant is required <br />to have a mining permit in order to remove more that 5,000 cubic <br />yards of sand from the site. <br />PLANNING AND ZONING ACTION: <br />At its March 22, 1990 meeting, the Planning and Zoning Commission <br />voted 5 to 1 to deny the project, because the Commission de- <br />termined that a required separation distance criterion is not <br />satisfied by the request. <br />ANALYSIS: <br />1.
