MAY 11990: <br />BOOR i� F,�GE,�V0 7 <br />Vice Chairman Bird felt the indication he was getting from <br />his fellow Commissioners is for denying the request based on the <br />County Attorney's opinion that to grant this sand mining special <br />exception would be in conflict with our existing ordinance. It <br />is a public hearing, but maybe we can shorten the process and get <br />on with our day's duties by having a show of hands of those who <br />are opposed to the Board granting special exception approval for <br />a sand mining operation.,- <br />Practically <br />peration., <br />Practically everyone raised their hands in response. <br />Vice Chairman Bird opened the Public Hearing, and asked if <br />anyone wished to be heard in this matter. <br />Art Holtan, resident of Kingslake Subdivision, felt the <br />issue was not totally about whether the dirt was to be allowed to <br />be hauled off site. He felt there is good reason to question <br />whether the lake should be allowed to be dug, because he was <br />having a hard time believing that the lake was not going to <br />affect the wells in the homes in the vicinity. Mr. Holtan <br />wanted to see the County readdress the way that regulation is <br />written. <br />There being no others who wished to be heard, the Vice <br />Chairman closed the public hearing. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Wheeler, the Board unanimously (4-0, <br />Chairman Eggert being absent) denied the applicant's <br />request for special -exception approval for a sand mine, <br />as recommended by staff in the above memo. <br />Commissioner Scurlock wanted staff to continue to look at <br />our ordinance in relation to its impact on water supply, and <br />Commissioner Bowman wished to see the whole matter revisited <br />especially the St. Johns River Water Management District's <br />requirement of 100-12o retention. <br />30 <br />r <br />
