MAY 11990 <br />-I <br />BOOK 19 PAGE <br />PISHOCK REQUEST FOR AFTER -THE -FACT BUILDING PERMIT FOR SEAWALL <br />CONSTRUCTION <br />The Board reviewed the following memo dated 4/17/90: <br />TO: James E. Chandler, <br />County Administrator <br />FROM: James W. Davis, P.E., <br />Public Works Director <br />SUBJECT: Mr. Charles Pishock - Seawall Construction - <br />Request for County Approval and Issuance of an <br />After -the -Fact Building Permit - 11686 A -1-A <br />REF. LETTERS: 1) Geneva Keen Acor, Coastal Technology <br />Corp. to Robert Keating dated August 15, 1989 <br />2Y Michael Walther, Coastal Technology Corp. <br />to Zames Davis dated Mar 7, 1990 <br />DATE: April 17, 1990 <br />DESCRIPTION'AND CONDITIONS <br />Following recent coastal erosion along the Atlantic Ocean <br />shoreline,of the north barrier island, Mr. Charles Pishock, <br />11686 AlA, arranged the construction of an approximate 100' <br />long seawall to protect his residence from future storm <br />surge. Prior to construction, neither a local building <br />permit nor a Florida DNR Coastal Construction Permit was <br />obtained. <br />In the summer of 1989, Coastal Technology Corp., agents for <br />Mr. Pishock, applied to the Florida DNR for an after -the - <br />fact Coastal Construction Permit. <br />In processing the application, the DNR required the <br />applicant to obtain from the appropriate local government <br />agency having jurisdiction, written evidence that the <br />proposed activity does not contravene local setback require- <br />ments, zoning codes, building codes, or local comprehensive <br />plan. <br />The Community Development and Public Works Departments, in <br />addition to the County Attorney's Office, have reviewed the <br />request to determine if the seawall construction is in <br />compliance with local codes and plans. Attached are <br />numerous memos and letters documenting staff's concerns and <br />the applicant's responses. <br />ALTERNATIVES AND ANALYSIS <br />Staffs final analysis of the request for a finding of local <br />compliance is as follows: <br />1) Section 25(X)(3)c. of the County Zoning Code, <br />"shoreline protection", states that "no rigid shore <br />protection structures shall be permitted except when <br />used as a part of the Comprehensive Plan for beach <br />restoration and when non-structural alternatives are <br />not acceptable." <br />48 <br />
