ON MOTION by Commissioner Wheeler, SECONDED by <br />Commissioner Bowman, the Board unanimously approved <br />the release of the above -listed utility liens, as <br />recommended by staff. <br />RELEASE OF LIENS ARE ON FILE IN THE OFFICE OF THE CLERK TO <br />THE BOARD <br />F. QUITCLAIM DEED FROM COUNTY FOR FORMER VISTA ROYALE WATER <br />TREATMENT PLANT SITE <br />The Board reviewed the following memo dated 5/1/90: <br />TO: Board of County Commissioners <br />FROM: Charles P. Vitunac - County Attorney <br />DATE: Mzly 1, 1990 <br />RE: QUITCLAIM DEED FROM COUNTY FOR <br />FORMER VISTA ROYALE WATER TREATMENT <br />PLANT SITE - BOARD MEETING 5/15/90 <br />CONSENT AGENDA <br />Mr. Mark Herman of the County's Fixed Assets Department <br />Informed us that the referenced property is listed on the <br />tax rolls in the name of Indian River County even though it <br />should have been transferred to Vista by the County as part <br />of a settlement of a 1985 lawsuit. <br />There are improvements on the site since 1985 built and used <br />by Vista. Lea Keller spoke to the officials at Vista, and <br />they informed her that they were under the impression that <br />this property had already been transferred to them, and they <br />had no idea that the tax rolls still listed the County as <br />the record owner. Lea contacted the County's Utility <br />Services Department and by memo, a copy of which is <br />attached, they advised that the County has no further use <br />for the property. In addition there is also the concern of <br />liability to the County should someone be injured while on <br />the property. <br />Therefore, our office prepared the attached quitclaim deed <br />conveying to Vista any interest that the County has in the <br />former Water Plant site.
