Thompson, P.E. ) <br />Capital Projects Manager <br />SUBJECT: Consent Agenda/United Parcel Service <br />Covenant to Construct Certain Off -Site Improvements <br />DATE: May 29, 1990 <br />----------------------------------------------------------------- <br />DESCRIPTION AND CONDITIONS <br />On April 26, 1990, The Planning and Zoning Commission <br />conditionally approved.the site plan for a United Parcel Service <br />(UPS) Distribution Facility to be located at 4555 41st Street. <br />Their approval was contingent upon the developer meeting specific <br />conditions recommended by staff. <br />One of the conditions of the site plan approval was the execution <br />of a developer's agreement between UPS and Indian River County <br />for the construction of a Westbound left -turn lane into the UPS <br />facility from South Gifford Road (41st Street). The County will <br />design and take bids for construction of the Westbound left -turn <br />lane in conjunction with an Eastbound left -turn lane that the <br />County has planned at 43rd Avenue. <br />The pre-bid estimate for the developer's share of the work is <br />$30,000.00. <br />After the County has made final payment to the contractor for <br />construction of the turning lanes, the County will refund to the <br />developer any funds that were paid to the County in excess of the <br />actual cost. <br />RECOMMENDATION AND -FUNDING <br />It is recommended that the County execute the attached agreement <br />with United Parcel Service, Inc. Funding in the amount- of <br />$150,000.00 is available in account 105-214-541-066-51 for the <br />County's share of the work. <br />ON MOTION by Commissioner Wheeler, SECONDED by <br />Commissioner Scurlock, the Board unanimously <br />approved the agreement with United Parcel Service Inc., <br />as set out in the above staff recommendation. <br />18 <br />7-7 <br />1 <br />
