Florida Statute 125.35 allows the Board of County <br />Commissioners to effect a private sale of the parcel after <br />sending notice of the intended action to owners of adjacent <br />property by certified mail when the value of the property is <br />$5,000.00 or less, as determined by the County Property <br />Appraiser, and when, due to the size, shape, location and <br />value of the parcel, it is determined by the Board that the <br />parcel is of use to only one or more adjacent property <br />owners. Mr. Spiva is the predominant adjacent owner, <br />surrounding the strip of land on either side to the east and <br />west. It also appears from the Property Appraiser's <br />Informational tax maps that two property owners to the <br />Immediate south of the Spiva may be adjacent to this strip <br />of land. <br />RECOMMENDATION <br />1. The Board should make a determination that the parcel <br />Is of use to only one or more adjacent property owners <br />due to the size,. shape, location and value of the <br />property, and that the parcel is worth $5,000.00 or <br />less as determined by the County Property Appraiser. <br />2. Send notice to adjoining property owners by certified <br />mail of the intent to effect a private sale and <br />conveyance of the parcel to Mr. Spiva for $1,000.00, <br />unless they notify the County within 10 days of their <br />interest in purchasing the strip of land. <br />3. Offer to sell the property for $1,000.00, the sum <br />representing the assessed value of $850.00 plus $150.00 <br />for administrative costs involved in the transaction. <br />4. Authorize the Chairman to execute a deed for the <br />property to any adjoining property owner who is the <br />high bidder, meeting the minimum bid requirement, or to <br />reject all bids. <br />Commissioner Bird brought up the possibility of making a <br />swap for future additional R/W requirements, but Attorney Collins <br />advised the,prob„lem with that is that the canal is on Mr. Spiva's <br />side of the road. <br />ON MOTION by Commissioner Scurlock, SECONDED by Com- <br />missioner Wheeler, the Board unanimously approved <br />staff recommendation and authorized the 4 actions <br />set out in said recommendation. <br />SOLID WASTE DISPOSAL DISTRICT <br />The Chairman announced that immediately upon adjournment, <br />the Board would reconvene sitting as the District -Board -of <br />Commissioners of the Solid Waste Disposal District. <br />J U L 101990 <br />
