the entity with the drainage jurisdiction will adopt the <br />discharge rate. In basins that are not within a water control <br />district, Public Works being the County's representative, would <br />have the ability to set the discharge rate. <br />Mr. Cain believed the question Mr. Smith raised of who has <br />the authority to adopt the discharge standard, and can the Indian <br />River Farms Drainage District do this without the approval of the <br />County and have the County enforce it, is something that does <br />need an answer. <br />Mr. Smith felt if there is an independent agency doing this <br />which has their own funds, possibly they should enforce this <br />themselves rather than dumping it off on the county. <br />County Attorney Vitunac commented that if our standards and <br />their's are inconsistent, this should be looked into, and his <br />office can look into this if Planning feels there is an incon- <br />sistency. <br />Mr. Cain believed the Comp Plan said we would adopt the <br />standards set by the Drainage District. Because of concurrency, <br />we have to make sure our drainage system is not over capacity; <br />so, we do have a responsibility, and he sees the question <br />relating to whether or not the County has to approve the <br />standards set by the Drainage District. <br />Asst. County Attorney Collins believed the County has the <br />authority to regulate the drainage, and as to whether we should <br />enforce district standards, he felt we have to because there is <br />no other development agency around and we are the only one who <br />can enforce these standards. He agreed that the Comp Plan has <br />adopted the District standards, but pointed out that the standard <br />that adopted did not happen until after, the Comp Plan; so, there <br />could be a question as to should we ratify that standard or just <br />accept the fact that they halve more expertise in establishing <br />their discharge figures. <br />Mr. Smith commented that he just raised those questions <br />because there is a <br />lot of confusion about <br />this -and how <br />it will be <br />AUG 0 9 1990 <br />35SO <br />uIAIO <br />
