AUG 0 y q,1a 8- ?S <br />- Commissioner Bowman expressed concern about protecting the <br />small oaks that seldom get to 4" DBH even at maturity. <br />Planner DeBlois agreed that is a good point but felt that <br />some of that will be covered under Upland Habitat Protection and <br />the conserva- tion setasides. <br />Director Keating noted that the more complex you make the <br />definition and criteria, the more difficult you make the <br />enforcement. <br />Planner DeBlois advised that they are trying to tie the <br />issuance of a land clearing permit more into the issuance of site <br />plan approval, but we still would allow clearing before site plan <br />approval for general maintenance. <br />Commissioner Bird referred to Page 2, Paragraph (2) in <br />regard to it being unlawful to perform any land -clearing or <br />grubbing unless a land -clearing permit has been issued and is <br />posted on-site and asked that the words "if required" be added. <br />Planner DeBlois confirmed that would be added. <br />Commissioner Bird asked when we get into whether a cabbage <br />palm is a protected species, and he was informed that right now <br />it is referenced as a landscape credit tree, but it is not listed <br />as a protected tree. <br />In discussion it was noted that the cabbage palm is the <br />State tree, but it was generally agreed to leave it off the list. <br />There was no public comment. <br />Planner DeBlois reviewed Chapter 928 - Wetlands and Deep- <br />water Habitat Protection, the highlights of which are as follows: <br />44 <br />M <br />M <br />
