CHAPTER 928 - WETLANDS & DEEPWATER HABITAT <br />PROTECTION <br />* NEW ORDINANCE BASED ON <br />COMPREHENSIVE PLAN POLICIES <br />* HIGHLIGHTS: <br />MITIGATION ALLOWANCES AND <br />REQUIREMENTS <br />MITIGATION BANK PROGRAM <br />NATIVE UPLAND EDGE VEGETATION <br />BUFFER ZONE <br />ASSESSMENT RELIEF <br />Planner DeBlois advised that there is some incentive for <br />restoration of wetlands, and the mitigation bank program is new. <br />Another change based on the Comp Plan is the Native Upland Edge <br />Vegetation Buffer Zone, which calls for a minimum of ten square <br />feet of such buffer for each linear foot of wetland or deepwater <br />habitat perimeter that lies adjacent to uplands - this upland <br />edge buffer to be located so that no less than 50% of the total <br />shoreline is buffered by a minimum width of 10" of upland <br />habitat. <br />Commissioner Bowman pointed out that 2 (a) on Page 2 refers <br />to raising flood heights, and she felt it should also say "or <br />lowering flood heights" because lowering is just as damaging. <br />Warren Dill questioned the provision on Page 4 that "No <br />activity shall be allowed that results in the alteration, <br />degradation, or destruction of wetlands..." and wanted to know <br />what happens if your property happened to be all wetlands. <br />Planner DeBlois advised that as it is written, the property <br />would have to meet one of the 3 criteria listed. <br />Commissioner Bird believed there is an ability to transfer <br />density off site, and Planner DeBlois confirmed that you can <br />transfer density to non-contiguous property. <br />Engineer Monte Falls believed at the workshops removal of <br />undesirable plants intermingled with mangroves was discussed and <br />he does not see it included here. <br />L_ AUG 0 9 1990 <br />45 <br />
