A U G 4 9 19 W BOCJK <br />Planner DeBlois explained that removal of nuisance <br />vegetation has been included in the Chapter on Upland Habitat <br />Protection. He agreed that we need,,to make it clear this would <br />carry over to the wetlands. <br />There was no further public comment on Chapter 928. <br />Planner DeBlois next addressed Chapter 929 - Upland Habitat <br />Protection, the highlights of which are as follows: <br />CHAPTER 929 - UPLAND HABITAT PROTECTION <br />* NEW ORDINANCE BASED ON COMPREHENSIVE <br />PLAN POLICIES <br />* HIGHLIGHTS: <br />UPLAND NATIVE PLANT COMMUNITY <br />CONSERVATION AREAS <br />ST. SEBASTIAN RIVER/INDIAN RIVER <br />LAGOON BUFFER ZONE <br />REQUIRED REMOVAL OF EXOTIC <br />NUISANCE VEGETATION <br />ENVIRONMENTAL SURVEY FOR <br />RARE AND ENDANGERED SPECIES <br />ASSESSMENT RELIEF <br />Planner DeBlois commented that the main part of this is the <br />percent set-aside the County adopted but which is still being <br />disputed. This chapter also calls for a 50' shoreline protection <br />buffer for unplatted parcels and a 25' buffer for existing <br />platted lots on parcels bordering the St. Sebastian River of the <br />Indian River Lagoon Aquatic Preserve, and we are proposing a <br />qualifier that in no case shall this buffer exceed 200 of the lot <br />depth. <br />County Attorney Vitunac referred to the last paragraph on <br />Page 10, which is as follows: <br />Sec. 929.14 Assessment Relief. <br />Any owner of ah undeveloped upland native plant community area who <br />has dedicated an easement or entered into a perpetual conservation <br />restriction with the Indian River County or a nonprofit <br />organization to permanently control some or all regulated <br />activities in the upland shall be exempted from special assessment <br />on the controlled upland to defray the cost of municipal <br />improvement such as sanitary sewers, storm sewers, and water mains. <br />46 <br />
