Collins II - Assistant County Attorney <br />L <br />DATE: August 31, 1990 <br />SUBJECT: Settlement Negotiations with Department of <br />Community Affairs <br />On August 14, 1990 the Board authorized County Administrator <br />Chandler, Community Development Director Keating and me to <br />travel to Tallahassee in an attempt to work out a settlement <br />with the Department of Community Affairs over our comprehen- <br />sive plan. I presented the potential approaches towards <br />settlement as set out in my memo to you of August 14, 1990. <br />Below is the summary result of those negotiations. <br />1. On the issue of inconsistency with the Treasure Coast <br />Regional Planning Council Native Upland Vegetation <br />Rule, the DCA staff seemed unwilling to consider <br />anything less than a 25% protection rule. We then <br />pointed out that the Indian River County proposal <br />Included protection through purchase as well as through <br />land development regulation, and that this 2 -pronged <br />approach would better accomplish the regional goals <br />than a regulation which was only applied to develop- <br />ments, many of which may not be in critical areas. I <br />believe the DCA staff came around to our position on <br />the Native Upland Vegetation Rule. Mr. Keating had <br />suggested purchasing 300 acres of pine flatwood by <br />1993. The DCA staff recommended that the plan identify <br />additional acquisition after 1993. <br />49 <br />
