ANALYSIS: <br />- SUBDIVISION: <br />Some required improvements for the subdivision have been <br />constructed; however, the subdivision construction is substantially <br />incomplete. A Contract for Construction for Remaining Required <br />Improvements has been submitted, as well as a Letter of Credit to <br />secure the contract. The County Attorney's Office has reviewed and <br />approved the submitted Contract for Construction and Letter of <br />Credit, and the Public Works and Utilities Departments have <br />reviewed and approved the submitted Engineer's Certified Cost <br />Estimate. It should be noted that once all improvements have been <br />completed and deemed acceptable, the developer will then submit a <br />Warranty/Maintenance Agreement and post suitable security to <br />guarantee the performance of the publicly dedicated improvements. <br />- RIGHT-OF-WAY ACQUISITION (58th Avenue): <br />The Public Works Department has determined that an additional 20' <br />of right-of-way along the project's 58th Avenue (Kings Highway) <br />frontage needs to be purchased now to implement the Thoroughfare <br />Plan. The cost of this right-of-way to the County will be <br />$8,478.15 (.4987 acre X $17,000/acre). The developer has requested <br />that a portion of this amount be retained by the County and <br />escrowed for construction of a required 5' sidewalk along 58th <br />Avenue (Kings Highway). This required sidewalk is valued at <br />$6,325.00 and, deducted from the required purchase amount for the <br />right-of-way, $2,153.15 would remain. The funding for the right- <br />of-way would come from District 4 and District 7 Traffic Impact Fee <br />Fund, with $2,153.15 paid to the developer and $6,,325.00 <br />transferred to the escrow account for sidewalk construction. Upon <br />recording of the final plat, the deed for purchase of the right- <br />of-way may then be recorded and the Plat Book and Page Number of <br />the recorded plat deed will be inserted on the legal description <br />of the right-of-way deed. <br />With the submission of the above referenced documents and <br />completion of the 58th Avenue right-of-way purchase, all applicable <br />requirements regarding final plat approval and recording will be <br />satisfied. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners: <br />1. Grant final plat approval for the High Pines Subdivision; _ <br />2. Authorize the Chairman to execute the submitted Contract for <br />Construction and accept the Letter of Credit, securing the <br />_contract; <br />3. Authorize the Public Works <br />additional 20' right-of-way for <br />the District 4 and District 7 <br />$8,478.151 $2,153.15 to be <br />$6,325.00 to be transferred on <br />.escrow account for construction <br />48 <br />SEP 04 1990 <br />Department to purchase the <br />58th Avenue with funds from <br />Traffic Impact Fee Fund for <br />paid to the developer and <br />behalf of the developer -to <br />of required sidewalks. <br />AJCK `''IJ <br />
