SEP 2 5 <br />1990 <br />Boa <br />47.1 <br />Commissioner Bird <br />felt as you visit these malls, <br />you <br />will <br />find that most of the stores in them there are drawn there <br />because of the mall concept and probably would not come here <br />otherwise. <br />Chairman Eggert commented that she gathers that by enlarging <br />the node, you are automatically rezoning because in staff's memo, <br />they do not mention rezoning to general commercial. <br />Director Keating felt that.is a good point, anal agreed that <br />should be in the memo. <br />Chairman Eggert believed the memo talks about an expansion <br />of the node to 316 acres and the recommendation says to enlarge <br />to 290. <br />Director Keating explained that the request is for enlarging <br />to 3.16 acres, but in looking at it, staff has recommended that be <br />reduced to 290 acres and he believed the applicant is now in <br />agreement with this. We would rather not have the wetlands and <br />stormwater facilities have a commercial designation, and that <br />takes out the 26 acres of wetlands and reduces the acreage to be <br />rezoned from 156 acres to 130. <br />Commissioner Scurlock had a question that he believed is <br />relative to the second issue before us today and that is what <br />hook we have to rezone the property if the applicant doesn't move <br />forward in nine months. He felt there is a lack of specific <br />language in terms of identifying any halt in construction, and <br />noted that we have had a case on the Barrier Island where a <br />developer has led us on for about 8 years by just setting another <br />block or moving a wheelbarrow, etc. He, therefore, wants to be <br />sure that we have language that says if the developer does not <br />commence construction and move forward in an orderly fashion to <br />completion, we can rezone the property back. <br />Attorney Vitunac assured him that we do have that language. <br />Commissioner Scurlock continued to stress that he wanted to <br />be sure we have all this before he approves any rezoning, and <br />32 <br />® M M <br />
