Commissioner Bowman brought up the 26 acre wetland area that <br />is not to be rezoned. She noted that this area is only a wetland <br />area because of an illegal flowing well. She believed the state <br />will require it be plugged, and stressed that we want to be sure <br />we have sufficient surface run-off to preserve that wetland when <br />the well is shut off. <br />Director Keating advised that Condition #9 in the Develop- <br />ment Order relates to wetlands and addresses this problem. He <br />did not know if it requires plugging of the well or just valving. <br />Director Keating then went over the staff recommendation <br />which is as follows: <br />RECOMMENDATION <br />Based on the analysis, including the Planning and Zoning <br />Commission's recommendation, and the comments made by the Treasure <br />Coast Regional Planning Council .and the State Department of <br />Community Affairs (DCA), staff recommends that the Board of County <br />Commissioners: <br />1. amend the Comprehensive Plan to: <br />a. enlarge the SR60/Rings Highway Node to 290 acres by <br />including the 130 acre site in the node; and <br />b. amend- the Traffic Circulation and Capital <br />Improvement Elements to reflect improvements <br />required by the Indian River Mall project. <br />2. incorporate within the Indian River Mall Development <br />Order provisions which prohibit the development of <br />peripheral commercial development prior to the regional <br />mall facility development and provisions which permit <br />the county sufficient time to change the property's land <br />use plan designation if the mall is.not constructed. <br />Director Keating explained -that one -of the reasons staff did <br />not give the. -Board a proposed ordinance actually amending the <br />Land Use Pian and changing the zoning is that they have been <br />working with the applicant in the last.few days to get a survey <br />of the wetlands area, and they now have a 2 page legal descrip- <br />tion that does that. What they would recommend is that the Board <br />vote to amend the Comprehensive Plan to include the 130 acres and <br />exempt the wetlands and approve the ordinance which they have <br />drafted but the Board does not yet have, which says that and has <br />the proper legal description excluding the wetlands area.
