itMayor Smith.told him that during his comments he made a motion <br />which was seconded by Ms. Beard, that we come up with a statement <br />or resolution to the County Commission indicating our concern <br />about the implementation of the mall on Route 60, and the lack of <br />traffic studies in the City and calling to their attention that we <br />are worried about what such a development will do to the planning <br />for the downtown area plus other existing commercial areas in Vero <br />Beach. He asked Mr. Doty if he will work with the City Attorney <br />to come up with such a resolution for Council -consideration at the <br />next meeting. <br />Mr. Wodtke said it is his understanding that the County is -going <br />to make the developer build five lanes between 60 and -12th Street. <br />Mr. Doty said the only problem is that the County may be acting on <br />this at'their next meeting which may be prior to our next meeting. <br />'He suggested.that we might send a letter to the County Commission <br />asking them to wait for our resolution before considering the <br />matter. <br />Mr. Braisted suggested that they direct the City Clerk to record <br />these comments in the minutes and forward the minutes over to the <br />County Commission, pending the preparation of a resolution. - <br />Mayor Smith told Mr. Doty if he would amend his motion to <br />authorize the Clerk to prepare those minutes with a cover letter <br />signed by the Mayor, summarizing the concerns of Council, we could <br />accomplish it in that manner. Mr. Doty said we might not even <br />need a resolution if that is the sentiment of Council that the <br />minutes and cover letter are sufficient and he amended his motion <br />to include that': Ms. Beard seconded the amendment to the motion <br />and it passed unanimously. l) <br />Attorney O'Haire felt the Board must abide by the Plan they <br />s <br />adopted and pointed out that it requires that they coordinate <br />with the municipalities. He further noted that the Plan pro- <br />hibits expansion of a node unless 70% of the node has been <br />developed, and only 150 of the node in question has been devel- <br />oped. He, therefore, contended that if the Board.grants the <br />expansion, they are acting directly in opposition to the policy <br />in the Comprehensive Plan, and that Plan has the force of law. <br />i Mr. O'Haire also stressed the adverse effect such an approval <br />would have on the on-going negotiations with the DCA who have not <br />yet approved the Comp Plan. He continued to argue the need to go <br />through all this if we really don't want or need a regional-malA <br />in this location. He noted that the people who livfe in this area <br />don't want to put their kids'on a bus on a 6 lane road, and <br />further noted that he has heard that this proposed project is, in <br />i <br />effect, a "spoiler" to protect the developer against the other <br />proposed mall.
