SEP 2 1990 <br />38.a to be modified to read: <br />"The developer hereby agrees to set back any and all development; <br />from the project's western boundary a distance sufficient to <br />accommodate a landscape strip (minimum width of 10') and a future <br />dedication of a strip of right-of-way (from 26th Street to S.R. <br />60) wide enough to accommodate the ultimate 66th Avenue road <br />improvement section. Said right-of-way strip shall be dedicated <br />without compensation to the County upon notification to- the <br />developer by the County that the dedication is needed to <br />accommodate the expansion of 66th Avenue•or the provision of other <br />improvements. The right-of-way strip and landscape strip shall be <br />depicted on all site plans covering this area."' <br />Director Boling -noted that the developer was anticipating <br />this being a 30' R/W strip, and it may be much more than that. <br />This is intended to keep the option open to go other than on the <br />Vista Plantation side. Section 39 deals with the roadway <br />improvements needed. <br />Commissioner Scurlock wished to be sure that what we are <br />saying is that the roadway improvements listed must be totally <br />completed, not just under contract or the money escrowed, before <br />a C.O. is issued for any portion of the subject project, and this <br />was confirmed by staff. <br />Commissioner Scurlock emphasized that he wanted to be sure <br />that everyone, both we and the developer, are sure what staff's <br />position is on this. <br />Commissioner Wheeler commented that he understood that <br />Public Works Director Davis could certify the road improvements <br />as being what he considered "substantially complete." <br />Director Davis confirmed that basically in road construction <br />if the pavement is in the ground and everything is completed <br />except for striping and sod work, the project can be considered <br />substantially complete and open to traffic. The real issue in <br />his opinion is getting the projects to contract, and if you can <br />get the road project to contract, he didn't see why it can't be <br />built as quickly as the mall can be built. <br />Commissioner Scurlock believed staff is taking the position <br />that concurrency requires these improvements to be complete. <br />Commissioner Wheeler noted that he would like to see the <br />words"substantially complete" in the D.O., and Director Keating <br />62 <br />- M M <br />
