and development permits have been granted, was requested by the <br />developer. <br />Commissioner Scurlock believed this will help them meet <br />their time schedule, and Board members had no objection to that <br />addition. <br />Director Boling continued to review the proposed'D.O. He <br />felt #5 re Buffering and Open Space is important, and he believed <br />we are in agreement with the applicant about the buffers; this <br />also is similar to the Shopco D.O. He further advised that the <br />wetlands area not included in the rezoning includes more than the <br />wetlands, and that would have to be designated as open space. <br />Provision #9 will include the wetlands in the conservation <br />easement and make sure they maintain that area and not let it be <br />invaded by exotics. Provisions #24 and #28 re Water Supply and <br />Wastewater state that the Utilities Service Department has to <br />verify to the Planning Division before a site plan is released <br />that capacity is there and the service infrastructure, as well as <br />the provisions for the effluent disposal. <br />Commissioner Scurlock noted that this means they are going <br />to have to pay for the capacity and it'actually has to be on <br />line. That's why that condition is important because it may be a <br />situation where all water capacity is reserved and if they need <br />additional capacity the developer must be on the hook for expand- <br />ing the portion of the plant to meet their needs. <br />Director Boling further advised that there is one change.in <br />Section 35 Day Care which allows them3 years to obtain approval <br />of a plan to meet the demand for child day°care services rather <br />than 2 years. <br />Commissioner Bird commented -that he wanted to be sure we <br />evaluate what the total needs are so we do not create competitive <br />conditions with the existing' day care services in the county, and <br />the Board members agreed. <br />Planning Director Boling then referred to the modified <br />language proposed for 38.a., as follows: <br />61 BUCK <br />EP 1990 <br />
