Gentile, CET <br />Civil Engineer <br />SUBJECT: Pay Request #5 from Marshall, McCully & Associates <br />for Petition Paving Projects: 33rd Street, 1st Street <br />SW and 26th Street <br />DATE: September 24, 1990 <br />----------------------------------------------------------------- <br />DESCRIPTION AND CONDITIONS <br />The Engineering Division has received Pay Request #5 from <br />Marshall, McCully & Associates for the above referenced projects. <br />The work is approximately 95% complete. The Engineer is waiting <br />for a response from the utility companies to show the new <br />location of the utility poles on the plans. <br />Marshall, McCully & Associates is requesting payment less 50 <br />retainage instead of the 10% which is stated in the Master <br />Agreement. The 5% retainage is adequate enough to cover the work <br />that remains to be done. <br />RECOMMENDATION AND FUNDING <br />It is recommended that motions be made to approve Pay Request #5 <br />leaving 5% retainage. <br />Funds will come out of Account #173-214-541-033.19. <br />Chairman Eggert was a bit concerned with the 10% retainage <br />being reduced to 50, and Public Works Director Davis advised that <br />in some cases when an engineer is substantially complete with 990 <br />of the work, and they are just waiting for a permit or some minor <br />item to come in that can hold them up for months, they may have a <br />cash flow problem. <br />Chairman Eggert hoped that if the project is essentially <br />complete, then nothing can happen that would require us to dig in <br />more than 5%. <br />Commissioner Scurlock felt that 10% really comes in more <br />when there are materials or something of that nature that haven't <br />54 <br />
