Chandler <br />County Administrator <br />BACKGROUND <br />SUBJECT: REQUEST FROM THE <br />FLORIDA EAST COAST <br />RAILWAY COMPANY <br />REFERENCES: <br />The Indian River County Board of County Commissioners adopted Ordinance <br />#86-45 which prohibits the sounding of railroad train horns and whistles <br />between 10:00 p.m. and 6:00 a.m. at public railroad crossings protected by <br />gates, lights, and bells. This ordinance took effect on November 1, 1986 for <br />the 19 public crossings within the unincorporated area. The City of <br />Sebastian implemented a similar whistle ban during 1989 for the five public <br />crossings within its municipal boundaries. However, the City of Vero Beach <br />never implemented a whistle ban for the eight public crossings within its <br />municipal boundaries. All of the 32 public railroad crossings within the <br />County are equipped with gates, lights, and bells. <br />Between November 1, 1986 and the present. four public railroad crossing <br />accidents occurred within the County: <br />1) Date: November 6, 1987 <br />Time: 2:00 p. m. <br />Location: 27th St. crossing within the Vero Beach <br />municipal boundaries <br />Accident Type: Vehicle drove around the lowered crossing gates <br />and sustained major damage <br />2) Date: May 25, 1989 <br />Time: 2:00 a.m. <br />Location: Oslo Road crossing within the unincorporated area <br />Accident Type: Vehicle drove around the lowered crossing gates <br />and sustained major damage including two fatalities <br />3) Date: June 29, 1989 <br />Time: 5:30 p.m. <br />Location: 12th St. crossing within the unincorporated area <br />Accident Type: Vehicle drove around the lowered crossing gates <br />and sustained major damage including a fatality <br />4) Date: September 1, 1989 <br />Time: 1:00 a.m. <br />Location: 41st St. crossing within *the unincorporated area <br />Accident Type: -Vehicle drove around the lowered crossing gates <br />and sustained minor damage <br />25 BOOK -_ PAGE r <br />
