Attorney Vitunac asked if Mr. Abood or the railroad has <br />advised their engineers that in Indian River County, in the <br />County's opinion, it is not a violation of the law to blow the <br />horn if they see something or someone on the track, and <br />Commissioner Wheeler could not imagine that in an emergency <br />situation, the engineer would not blow the horn instinctively <br />Whether it was a violation of the ordinance or not. <br />Mr. Abood asked if he was suggesting that the railroad <br />violate the law. He pointed out that he is here to see about <br />changing the law so they wouldn't have to violate it. <br />Comment was made that possibly the answer would be to get the <br />state to change the statute. <br />ON MOTION by Commissioner Scurlock, SECONDED by Com- <br />missioner Wheeler, the Board unanimously (4-0) denied <br />the railroad's request and approved staff's recommenda- <br />tion that we not change our existing ordinance banning <br />the sounding of railroad train horns and whistles <br />between 10:00 P.M. and 6:00 A.M. <br />REQUEST TO ABANDON PORTION OF 44TH ST.
