Nov 6 1990 <br />BOOK F'A;E <br />RIGHT-OF-WAY ACQUISITION - 5TH STREET SW - MISTY MEADOWS <br />SUBDIVISION PROPERTY <br />The Board reviewed the following memo dated 10/29/90: <br />TO: James E. Chandler <br />County Administrator <br />THROUGH: James W. Davis, P.E. <br />Public Works Director <br />FROM: Donald G. Finney, SRAM meq, <br />=>r: <br />Right-of-Way•�, .. Acquisition Agent <br />SUBJECT: Right -of -Way Acquisition 5th Street SW/aka Rebel Road <br />Misty Meadows Subdivision - BUDGET AMENDMENT 004 <br />DATE: October 29, 1990 <br />DESCRIPTION AND CONDITIONS <br />.` 80' of right-of-way is required on 5th Street S.W. There is <br />presently existing a 301 county owned right-of-way. <br />The developer of Misty Meadows Subdivision has dedicated 30, of <br />right-of-way on the Preliminary plat which was approved by the <br />rte county on September 27, 1990. An additional 20' of right-of-way is <br />v- k: :;. <br />---.required to make up the deficit pursuant to the Thoroughfare Plan. <br />_s <br />.'{ The developer, through his attorney, Steve Henderson, is willing to <br />sell the 20' right-of-way to the count for . 6239 per square foot <br />.` ..< g Y Y P � <br />6,554.8 square feet for a Total Just Compensation of $4,090.00. <br />This appears to be an equitable settlement in that the county <br />recently acquired 20' of right-of-way from the adjoining Rivularis <br />Subdivision for .75(� per square foot (5,760 square feet $4,000.00). <br />RECOMMENDATION AND FUNDING <br />Staff recommends that the Board of County Commissioners approve the <br />purchase, or Traffic Impact Fee Credit, for the 20' x 327.74 right- <br />of-way to be acquired from Misty Meadows Subdivision property for <br />a Total Just Compensation not to exceed $4,090.00. <br />Funding to be from Traffic Impact Fee Zone 6, Account # 101-156- <br />541-066.12. <br />ON MOTION by Commissioner Scurlock, SECONDED by,-` <br />Commissioner Bowman, the Board unanimously approved <br />Budget Amendment #004 for the purchase of right-of-way <br />from Misty Meadows Subdivision property for an amount <br />not to exceed $4,090, as set out in the above staff <br />recommendation. <br />54 <br />
