N� <br />County Engineer T <br />SUBJECT: CR512/Florida East Coast Railroad Crossing <br />DATE: October 29, 1990 <br />----------------------------------------------------------------- <br />DESCRIPTION AND CONDITIONS <br />County Staff has negotiated with the Florida Department of <br />Transportation a tentative agreement whereby Florida East Coast <br />Railroad would agree to the new crossing for westbound CR512 for <br />the closing of two existing crossings. In order to expedite this <br />process the Florida Department of Transportation has asked the <br />county 6 discuss this proposal and see if it is acceptable and <br />to return the county's reply to the Department of Transportation <br />as soon as possible. The department has also requested us to <br />provide them with the locations of the two crossings that could <br />be closed if this proposal is acceptable to the county. <br />ALTERNATIVES AND ANALYSIS <br />Florida Statutes 335.141 places responsibility for regulating <br />. ­.. •. `.» 'public railroad crossings with the FDOT. If the county did not <br />.'agree to this proposal,the FDOT could make a decision and the <br />"J county would have to contest the decision through the <br />administrative process.
