McCov ``� <br />Staff Planner -"Current Development <br />• DATE: November 9, 1990 <br />SUBJECT: Wellington Stevens II Request for Plat Vacation for a <br />Portion of Gloria Gardens Subdivision <br />It is requested that the data herein presented be given- formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of November 20, 1990. <br />DESCRIPTION AND CONDITIONS <br />Wellington Stevens II is requesting that the Board of County <br />Commissioners vacate a portion of the Gloria Gardens subdivision as <br />recorded in plat Book 5, Page 33 of the Public Records of St. Lucie <br />County, Florida, said land now lying and being in Indian River <br />County, Florida. The portion of the plat to be vacated includes <br />(see attachment 3) all of Block 1, lots 1-8 in Block 2, and a park <br />tract, all of which are owned by Wellington Stevens II. It should <br />be noted that the road rights-of-way originally platted as part of <br />the Gloria Gardens subdivision have been previously abandoned. <br />Thus, only the actual lots and park tract remain to be vacated. <br />The subject property is located in the southeast quadrant of the <br />8th Street/Old Dixie Highway intersection. <br />The portion of the plat to be vacated does not affect public or <br />private facilities, or access rights other than those associated <br />with the lots being vacated. The applicant has been granted a <br />preliminary plat approval for Glendale Industrial Park on the <br />subject property and has constructed subdivision improvements <br />consistent with the approved preliminary plat. This portion of the <br />Gloria Gardens plat must be vacated prior to'final plat approval <br />being granted for Glendale Industrial Park <br />ANALYSIS <br />According to Chapter 177.101 of the Florida Statutes, the Board of <br />County Commissioners has the authority to vacate plats in whole or <br />in part, returning all or portions of the property to acreage. The <br />vacation is accomplished by resolution of the Board. Before the <br />resolution can be approved by the County Commission: <br />1. It must be shown that the persons making application for the <br />vacation own fee simple title to the property covered by the <br />plat sought to be vacated. <br />2. It must be shown that the vacation will not affect the <br />ownership or the right of convenient access of persons owning <br />other parts of the subdivision. <br />1 71 <br />22 <br />
