Currently 90' of <br />right-of-way exists for 43rd Avenue, and compensable <br />dedication of up to 10' will be required from the subject <br />property. The applicant is required to work with the Public <br />Works Department and dedicate right-of-way along 43rd Avenue, <br />as can be adequately compensated by the County. <br />13. Specific Land Use Criteria - Special Exception Use: <br />1. No building or structure shall be located closer than <br />thirty (30) feet to any property line abutting a <br />residential use or district. <br />2. Access shall be from a major thoroughfare or as otherwise <br />approved by the county engineer. <br />3. Any accessory residential use or school upon the premises <br />shall provide such additional lot area as required for <br />such use by this section and shall further be subject to <br />all conditions set forth by the reviewing body. <br />Accessory residential uses may include convents, <br />monasteries, rectories or parsonages. <br />4. Type "B" screening, as defined in Section 23.3(g)(7), <br />shall be provided along all property boundaries when the <br />facility is located within or adjacent to a residential <br />district. <br />The project's conceptual plan meets the applicable special <br />exception criteria. <br />14. Surrounding Land Use and Zoning: <br />North: RS-3/Residential <br />South: RS-3/Division of Forestry Building <br />East: RS-6/Residential <br />West: RS-3/Residential <br />RECOMMENDATION: <br />Based on the analysis performed, staff recommends that the Board of <br />County Commissioners grant approval of the special exception use <br />and corresponding conceptual site plan with the following <br />conditions: <br />1. Prior to release of any approved final site plan: <br />a. The applicant shall dedicate to the County up to 10' of <br />additional right-of-way for 43rd Avenue, subject to <br />compensation. <br />b. The developer shall either establish a conservation <br />easement(s) or dedicate funds (fee -in -lieu of <br />preservation) or a combination of both to meet the <br />Conservation Element Policy 6.12 (native upland <br />vegetation set-aside). <br />DEC 419 . 17 BOOT 8210 PAGE 6115 <br />
