DEC 4 X990 BOOK,> F�.t <br />Director Keating reiterated that the neon lights issue does <br />not affect the release of easement, but Commissioner Scurlock <br />stressed that he just didn't want to do anything here today that <br />would give the applicants an argument for their neon lights. <br />Chairman Eggert felt the question is whether we want to <br />reopen the question of what we mean by neon and encased neon, but <br />Commissioner Scurlock just didn't want us to give them the <br />argument of saying, "you liked our neon lights when you gave us <br />the release of easement." <br />Commissioner Bowman anticipated that their argument would be <br />that the neon is an integral part of their architecture, but <br />Commissioner Bird understood that they have agreed that the neon <br />will have to be covered and that they are making the <br />modifications now at the factory to enclose the neon in some kind <br />of plastic encasement. <br />In that case, Commissioner Scurlock felt he was ready to <br />make a Motion that the Board approve the the release of easement <br />contingent upon them putting that in writing. <br />Attorney Vitunac felt this release of easement should be a <br />separate issue since a separate corporation owns the land and <br />is asking for a simple easement abandonment. With regard to <br />whether the County issues a building permit to Checkers, all of <br />the Board's statements are well -taken and Director Keating has <br />got to answer those before he issues that building permit, which <br />will be to a different company than the company owning the <br />property. <br />Commissioner Scurlock still wished to make his Motion <br />contingent on us receiving a letter stating that they accept our <br />neon r-e-qu i rement s . <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, that the Board approve the release <br />of easement with a condition that we receive some <br />correspondence that they cannot have exposed neon in <br />this county and that they understand that this release <br />of easement is a separate issue. <br />
