M M <br />Communitv Development Director advised that this is an <br />unusual situation because staff is changing its recommendation on <br />it. He explained that during the site plan review process, the <br />applicant was informed that there were substantial right-of-way <br />deficiencies on both Oslo Road and 27th Avenue and that <br />right-of-way would have to be acquired/purchased by the County. <br />At that time, since he would be losing commercial land, the <br />applicant inquired if there was an opportunity for a commensurate <br />amount of land to be added to the node adjacent to this property. <br />Staff indicated to him that would be possible and that staff <br />would look at that favorably. However, when the applicant <br />submitted his Comp Plan amendment request, there had been no <br />action on actually taking the right-of-way out of the node, so <br />staff told the applicant that until the right-of-way actually was <br />severed from the node and that amount of land made available, <br />staff would not recommend favorably on a land use amendment. <br />That is the reason why today's staff recommendation was written <br />up for denial of the request. Subsequently, the applicant has <br />coordinated with Public Works Director Jim Davis and the County <br />Attorney's Office and a later item on today's Agenda involves <br />County acquisition of this right-of-way. Staff feels this is <br />sufficient for the land to be severed. If that item is approved, <br />the County would go in and acquire the property under the <br />appraised value. Director Keating felt that everyone will win in <br />this situation. The. County will get what is needed, and the <br />applicant will be able to do his project in more area. If for <br />some reason the Board doesn't agree to purchase this right-of-way <br />when that matter is considered later in today's meeting, the <br />decision right here is not final. It can be considered when it <br />comes back from Tallahassee after DCA consideration of the land <br />use change. Basically, this is a request for adding 4.83 acres <br />to the commercial node. The amount of right-of-way the applicant <br />is <br />giving up <br />is 2.28 acres, but staff agreed <br />that the <br />additional <br />DEC <br />111990 <br />107 <br />P00K. <br />:� FA c ? <br />
