The P&Z Commission did recommend denial of <br />this, but that was based under a different set of circumstances <br />than what is being presented to the Board today. In working <br />through the whole process, staff looked at the concurrency <br />situation, and determined that since utilities are not available <br />to the site at the present time, the applicant would have to <br />agree to enter into a developer's agreement and pay the 5% prior <br />to a final action on this matter. However, if the developer <br />actually has proceeded with his, site plan approval by that time, <br />he may eventually require the ERUs, but that still would come <br />after a final hearing on the land use amendment request. <br />Chairman Eggert opened the Public Hearing, and asked if <br />anyone wished to be heard in this matter. There being none, she <br />closed the Public Hearing. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously approved <br />the transmittal of the Oslo Plaza Associates' request <br />to amend the Comprehensive Plan from L -Z to Commercial <br />Node, and announced their intention to hold a final <br />public hearing concerning this matter, as recommended <br />by staff. <br />108 <br />
