SEBASTIAN RIVER MANATEE PROTECTION ZONES DURING <br />FDNR RULE HEARINGS <br />It is requested that the data herein be given formal consideration <br />by the Board of County Commissioners at its regular meeting of c <br />December 11, 1990. <br />DESCRIPTION AND CONDITIONS: <br />In a letter dated August 15, 1990, Beth Beeler of the FDNR Division <br />of Marine Resources requested that county staff provide the State <br />with draft legal descriptions and maps to aid in the State's <br />preparation of materials for rulemaking on Indian River County <br />manatee protection zones. Rulemaking public hearings pertaining to <br />Indian River County are expected to occur in January or February <br />1991. <br />Subsequently, staff submitted draft legal descriptions and <br />accompanying maps to FDNR on October 18, 1990. As explained in a <br />cover letter, the submitted information did not include the St. <br />Sebastian River protection zone descriptions, in that such <br />information had already been submitted to FDNR for earlier <br />rulemaking hearings that had been held regarding Brevard County and <br />the St. Sebastian River. On June 26, 1990, the Governor and <br />Cabinet voted to establish a slow speed zone throughout the Indian <br />River County portion of the St. Sebastian River, contrary to the <br />Board of County Commissioner's recommendation of the establishment <br />of a 20 mph travel corridor in the river's northern portion. <br />Mr. Richard Giteles of the Sebastian Inlet Tax District reviewed a <br />copy of the October 18, 1990 cover letter from county staff to FDNR <br />and expressed concern that the letter might be misconstrued by FDNR <br />to indicate that the Board of County Commissioners had changed its <br />stance of support of a 20 mph travel corridor in the St. Sebastian <br />River (between the US#1 bridge and FEC railroad tracks) <br />According to Mr. Giteles, as expressed in a letter to Commissioner <br />Bird on November 2, 1990, the FDNR may consider re -addressing the <br />St. Sebastian River manatee protection zones, particularly if there <br />is local support for a re -consideration as part of upcoming Indian <br />River County rulemaking hearings. <br />ALTERNATIVES & ANALYSIS <br />In response to concerns raised by Mr. Giteles, county staff <br />contacted FDNR staff to determine if the St. Sebastian River <br />manatee protection zones are to be re -addressed during the overall <br />Indian River County rulemaking hearings to be held early next year. <br />17 Wo <br />C E C 111990 <br />
