B00K 8 3 FADE 141 <br />Commissioner Wheeler commented that as he understood the <br />proposed ordinance, church ground parking lots would be con- <br />sidered public places so you couldn't put handbills on the cars <br />parked there. <br />This was confirmed by Asst. County Attorney O'Brien, who <br />also pointed out that there is no prohibition against handing <br />them out to individuals. <br />Commissioner Wheeler believed you can put handbills on <br />private property on door knobs, for instance, and Attorney <br />O'Brien agreed that you can unless the premises is posted "No <br />trespassing, etc." <br />Commissioner Bowman pointed out that on Page 1 of Attachment <br />"A" the definition of commercial handbill says "except news- <br />papers," but Page 2, paragraph 3, talks about a publication that <br />is essentially and predominantly advertising with some capsule <br />news items, and that is all this thing is. <br />Attorney O'Brien explained that what we are trying to <br />prohibit is the distribution of handbills which are publications <br />that are predominantly advertising, and Attorney Vitunac further <br />clarified that a real newspaper can be distributed, but an <br />advertising type newspaper cannot be indiscriminately thrown <br />around. <br />Commissioner Bowman later wished to know what "carting" of <br />handbills is, and Attorney O'Brien advised this wording is taken <br />from another ordinance; he guessed it is more or less bringing <br />them around; and he felt that language could be left out. <br />The Chairman asked if anyone present wished to be heard. <br />William Koolage, 815 26th Avenue, came before the Board and <br />handed out examples of advertising type newspapers which are <br />thrown around in neighborhoods, such as the Vero Beach/Sebastian <br />Advertiser and The Beachcomber. <br />Commissioner Bird wished to know if this ordinance makes <br />this type newspaper illegal, and Attorney O'Brien advised that it <br />does if someone objects in writing to having them thrown on their <br />22 <br />M <br />
