ROOK FACE 70 <br />D E C 111990 <br />James Young of Kimley-Horne next came before the Board <br />representing Edmund Lappeman, owner of about 16 acres of land <br />just south of Grand Harbor, who has filed a petition for an <br />administrative hearing to object to several of the issues of the <br />Comp Plan. Mr. Young advised that the way staff has rewritten <br />Policy 1.31 of the Future Land Use Element is unacceptable to Mr. <br />Lappeman, and on the last page of his Stipulation he is <br />requesting a proposed amendment as follows: <br />PROPOSED AMENDMENT TO FUTURE LAND USE ELEMENT <br />Submitted on behalf of Edmund Lappeman <br />October 29, 1990 <br />The boundaries between conservation land use categories and non - <br />conservation land use categories indicated on the generalized Future <br />Land Use Map are approximate and are not intended to specifically <br />delineate where one land use category begins and another ends. Such <br />boundaries are general designations which will be specifically <br />determined by environmental survey conducted in accordance with <br />Policy 1.31 of the Future Land Use Element. If an environmental survey <br />demonstrates that a parcel of property Is erroneously designated, the <br />boundary between land use designations may be shifted so that the land <br />` use designation applicable to contiguous property shall apply without <br />amendment of the Comprehensive Plan or the Future Land Use Map. <br />Mr. Young further advised that in an effort to resolve this <br />problem, they have prepared a stipulation for dismissal of Mr. <br />Lappeman's petition to intervene if the Board approves their <br />proposed amendment. <br />Chairman Eggert did not believe we have received notice of <br />an intervention, and Attorney Collins explained that Mr. Lappeman <br />has been one of the intervenors since the beginning but he has <br />not filed a Comp Plan amendment as the other intervenors did <br />because the only issue was that if his property was determined <br />Environmentally Sensitive, he wanted an assurance that the <br />adjacent Land Use designation would apply to the non -sensitive <br />lands that he owned, and apparently the wording staff has put in <br />to address that is not satisfactory. <br />60 <br />
