11AR 1, M1 <br />BOOK 82 <br />TO: Board of County, Commissioners <br />FROM: Doug Wrights, Director <br />Department of Emergency Services <br />DATE: January 24, 1991 <br />SUBJECT: Approval of Interlocal Agreement with <br />Troop L, Florida Highway Patrol, Relating <br />to Radar Units Purchased by Indian River County <br />It is respectfully requested that the information contained herein be <br />given formal consideration by the Board of County Commissioners at <br />the next regular scheduled meeting. <br />DESCRIPTION AND CONDITIONS <br />In 1985 and 1989, the Indian River County Board of County <br />Commissioners approved the purchase *of four radar units each year for <br />a total of eight units for the Florida Highway Patrol. The radar <br />units were purchased for use by Troop L in Indian River County. <br />The radar units purchased by the county are identified on the <br />attachment which was obtained from the fixed asset records of the <br />county and verified by the Florida Highway Patrol. <br />The Florida Highway Patrol has submitted the attached Agreement <br />relating to the use, ownership, and maintenance of the radar units <br />purchased for Troop L. The units are operational and being used on <br />a routine basis by the assigned officer per Trooper Byron Sickman. <br />ALTERNATIVES AND ANALYSIS <br />No action is being requested by the Florida Highway Patrol other than <br />approval of the Agreement. <br />This agreement is different from the one approved by the Board on <br />February 5, 1991, for Troop J (Turnpike Troop). The Troop J <br />Agreement in Article Two stated that the County is the lawful owner <br />of the radar unit and that the FHP would be the custodian and <br />responsible for the installation, maintenance, and repair of the <br />radar units. <br />The Agreement submitted by Troop L indicates in Article Two that the <br />County shall be the lawful owner of the eight radar units and <br />responsible for the maintenance and repair of the radar equipment. <br />Staff does not feel this section of the agreement would have a <br />substantial impact on funds for maintenance or other equipment since <br />the four radar units purchased in 1989 have five year maintenance <br />agreements which will cover the units through 1994. <br />The five year maintenance agreement for the four units purchased in <br />1985 will expire in 1991, however, the FHP indicates that they plan <br />to ask the County to replace these four units by submitting a budget <br />request for consideration by the Board. If the Board approves the <br />new purchase request, the language in the Agreement will not impact <br />this Department as staff would not have to fund any maintenance costs <br />for the units. If approval is denied, staff would have to budget for <br />projected maintenance expenses of the older units. <br />24 <br />M M <br />
