HAR 12 1991 <br />COOK F'AUE els <br />Mr. Allen felt Section 201.06 seemed to indicate that if the <br />line goes past his place he would have to hook up. When <br />Commissioner Scurlock said he would not have to hook up, Mr. Allen <br />indicated he was confused. <br />Commissioner Scurlock agreed there is confusion and he felt we <br />may never be able to explain it. He again explained it is <br />mandatory only if you paid and reserved capacity. If you have not <br />reserved capacity and if you have not volunteered there is nothing <br />there for you to hook into. The line is there but there is no <br />capacity at the plant. <br />Mr. Allen asked what about if there is capacity. <br />Commissioner Scurlock explained the only way there will be <br />capacity is if you come in and pay and then we can expand the plant <br />and you hook up. Commissioner Scurlock assured Mr. Allen that if <br />he did not desire service he would not be forced to hook up. <br />Mr. Allen stated he had attended the City of Sebastian Council <br />meetings where they had discussed 55% grants for small communities, <br />such as Sebastian and wondered why the County cannot do something <br />like that. Commissioner Scurlock assured him that the County <br />pursues every bit of federal and state funds, if it's available; <br />it's just that there isn't much out there. <br />Mr. Allen asked, if the City of Sebastian decided to withdraw <br />from the project, eliminating approximately 2,000 customers, how <br />the County would cover that. <br />Commissioner Scurlock explained that would only mean the new <br />million -gallon -a -day expansion would not be necessary and we would <br />simply use the existing plant and reallocate the capacity. <br />Mr. Allen was provided a copy of all impact fees, rates and <br />charges and he expressed concern for the senior citizens who will <br />not be able to afford the fees and charges, let alone the monthly <br />bill. <br />Scott Nerling (phonetic) came before the Board and expressed <br />his confusion, and he thought a lot of people are confused about <br />mandatory hookup. He quoted from Section 201.02, Connection with <br />Water System Required, "The owner of every lot or parcel within the <br />County shall connect, or cause the plumbing of any mobile home, or <br />trailer thereon, to be connected with the Water System of the <br />County or franchised private utility system, upon the approval of <br />the Department, and use such facility within 60 days following <br />notification to do so by the Department. All such connections <br />shall be made in accordance with the rules and regulations which <br />shall be adopted from time to time by the County." That sounds to <br />him as if it is mandatory and maybe he is misconstruing something <br />here. <br />48 <br />
