® M <br />there is a section for Emergency Acquisition. <br />Commissioner Bowman thought, then, that it should be cross- <br />referenced. <br />ross- <br />referenced. <br />Chairman Bird suggested taking out the word "not" and saying, <br />"The Board may add or expand projects on the prioritized <br />acquisition list by following the proper procedures for submitting <br />something.to it." <br />Commissioner Wheeler saw no reason for this as the system is <br />already set up that.way, and did not like putting down in writing <br />anything giving the appearance that an advisory board can say the <br />Commission may not do something. <br />Commissioner Scurlock did not read it that way but thought, if <br />that is the way it could be read, perhaps it should be clarified. <br />Attorney Vitunac advised that in the Emergency Acquisition <br />Section it states, "Before any action can take place the Advisory <br />Committee will be required to formally declare an emergency <br />acquisition situation." He felt if this wording allowed the Board <br />to declare an emergency that would be a way out, but it is not <br />written that way. <br />Commissioner Eggert continued to express her dissatisfaction <br />with any wording that says "the Board may not," but emphasized that <br />she has no quarrel with sending everything through the LAAC. <br />Discussion continued regarding the powers of advisory <br />committees and the powers of the Board. There were various <br />suggestions for changes in the wording regarding emergency <br />situations. <br />Commissioner Wheeler agreed that any property that comes <br />before the Commission should go through the Committee, and if there <br />are extenuating circumstances, the Board should have the <br />opportunity to declare an emergency. <br />Director Keating asked if the Board is indicating they want <br />the Board to be able to declare an emergency and then properties <br />that are declared emergencies would go through LAAO; this was <br />confirmed. <br />Attorney Vitunac commented that possibly in some cases you may <br />have to skip the LAAC because of timing but the Board members <br />believed that is what we are specifically tryng to avoid. <br />Chairman Bird felt if a property is declared to be of an <br />emergency nature there could be some short cut process to get it <br />through the Committee. (In further discussion, it was felt <br />something like this could be worked out.) <br />Commissioner Wheeler agreed and pointed out, again, that <br />actually this is just a guide and the Board can negate it with <br />three votes. <br />61 <br />wl . 83 <br />MAY � 1991 <br />
