DeBlois, AICP-W11 <br />Chief, Environmental Planning <br />DATE: March 7, 2011 <br />RE:, Request for Authorization to Abate Recurrence of a Public Nuisance on an Unmaintained <br />Golf Course within Vista Gardens Multifamily Development (Landowner: Vista Golf <br />LLC; Code Enforcement Case No. 2009060086) <br />It is requested that the Board of County Commissioners formally consider the following information at <br />the Board's regular meeting of March 15, 2011. <br />DESCRIPTION AND CONDITIONS <br />Vista Golf, LLC owns an unmaintained golf course within Vista Gardens, a multifamily development east <br />of Indian River Boulevard near 4th Street. In August 2009, the County Code Enforcement Board, after <br />finding Vista Golf, LLC in violation of County Code Section 973.03(1) for weeds in excess of 12 inches <br />in height on the golf course property, entered an "Order Imposing Fine and Determining Public Nuisance <br />Warranting County Abatement" resulting from Vista Golf's failure to comply (see Attachment 2 to this <br />report). On September 22, 2009, the Board of County Commissioners considered the matter and <br />authorized staff to hire a contractor to abate the weed nuisance. <br />Subsequently, county staff proceeded to hire a contractor and, on October 7, 2009, the property was <br />mowed. The cost of that mowing totaled $850.00, with the money coming from MSTU Code <br />Enforcement Budget funds ("Other Professional Services"). In November 2009, the Code Enforcement <br />Board entered orders acknowledging Vista Golf's compliance and assessing costs. <br />Since October 2009, the Board of County Commissioners has, on five occasions, authorized staff to hire a <br />contractor to mow overgrowth that recurred on the Vista Golf property.
