shall then submit a Change Order in order to avoid resources or mitigate as required to proceed with <br />project. <br />ARTICLE 5 - BONDS AND INSURANCE <br />SC 5.01 A Delete existing paragraph 5.01 A of the General Conditions in its entirety and replace with <br />the following: <br />A. Contractor shall furnish a Public Construction Bond in an amount equal to the Contract Price as <br />security for the faithful performance and payment of all of Contractor's obligations under the <br />Contract Documents. The bond shall remain in effect until one year after the date when final <br />payment becomes due or until completion of the correction period specified in Paragraph 13.07, <br />whichever is later, except as provided otherwise by Laws and Regulations or by the Contract <br />Documents. Contractor shall also furnish such other bonds as are required by the Contract <br />Documents. Pursuant to Florida Statutes section 255.05(1)(a) (2007), any claimant (as such term <br />is defined in Florida Statutes section 713.01) may apply to Indian River County as Owner for copies <br />of the Agreement and the recorded payment and performance bonds and shall thereupon be <br />furnished with certified copies of such documents. <br />SC 5.01B Delete reference to "all bonds" and replace with "the bond" throughout the entire <br />paragraph. (Total of 2 replacements) <br />SC 5.03B Delete existing paragraph 5.0313 of the General Conditions in its entirety. <br />SC 5.04B Delete existing paragraph 5.04B of the General Conditions in its entirety and replace with <br />the following: <br />B. The Contractor shall not commence Work under the Agreement until it has obtained all insurance <br />required under the Agreement and the Indian River County Risk Manager has approved such <br />insurance. The Contractor shall procure and maintain, for the duration of the Agreement, the <br />minimum insurance coverage as set forth herein. The cost of such insurance shall be included in the <br />Contract Price. <br />C. The insurance required by paragraph 5.04A of the General Conditions shall provide coverage for <br />not less than the following amounts or greater where required by Laws and Regulations: <br />1. Workers' Compensation: To meet statutory limits in compliance with the Workers <br />Compensation Law of Florida. This policy must include employers' liability with a limit <br />$500,000 for each accident, $500,000 disease policy limit and $100,000 disease each <br />employee. Such policy shall include a waiver of subrogation as against Owner on account <br />of injury sustained by an employee(s) of the Contractor. <br />2. Commercial General Liability: A per occurrence form policy, including Premise Operations, <br />Independent Contractors, Products and Completed Operations including X, C, U (Explosion, <br />Collapse, Underground) Broad Form Property Damage, Broad Form Property Damage <br />Endorsement, with a combined single limit of not less than $1,000,000 general aggregate to <br />include products/completed operations, personal injury/advertising liability, fire damage <br />/legal liability, and medical payments. <br />3. Business Auto Liability: Coverage shall include Owned vehicles and Hired/Non-Owned <br />l ( vehicles, for a combined single limit (bodily injury and property damage) of not less than <br />
