B. In evaluating Bids, Owner will consider the qualifications of the Bidder, whether <br />or not the Bids comply with the prescribed requirements, and such alternates, unit <br />( prices, and other data, as may be requested in the Bid Form or prior to the Notice <br />of Award. <br />C. Owner may consider the qualifications and experience of subcontractors, <br />suppliers, and other persons and organizations proposed for those portions of the <br />work as to which the identity of subcontractors, suppliers, and other persons and <br />organizations must be submitted as provided in the Supplementary Conditions. <br />Owner may consider the operating costs, maintenance requirements, performance <br />data and guarantees of major items of materials and equipment proposed for <br />incorporation in the work when such data is required to be submitted prior to the <br />Notice to Award. <br />D. Owner may conduct such investigations as Owner deems necessary to assist in the <br />evaluation of any Bid and establish the responsibility, qualifications, and financial <br />ability of Bidders, proposed subcontractors, suppliers, and other persons and <br />organizations to perform and furnish the work in accordance with the Contract <br />Documents to Owner's satisfaction within the prescribed time. <br />E. If the Contract is to be awarded, it will be awarded to the lowest Bidder whose <br />evaluation by Owner indicates to Owner that the award will be in the best interests <br />of the Owner. <br />F. If the Contract is to be awarded, Owner will give the Successful Bidder a Notice <br />of Award within ninety days after the day of the Bid opening. <br />G. More than one Bid from an individual, firm, partnership, corporation, or <br />association under the same or different names will not be considered. Reasonable <br />grounds for believing that one Bidder is financially interested in more than one <br />proposal for the same work will cause the rejection of all proposals in which such <br />Bidders are believed to be interested. Any or all proposals will be rejected if there <br />is reason to believe that collusion exists among the Bidders, and no participants in <br />such collusion will be considered in future proposals for the same work. <br />H. Within fifteen (15) calendar days of the date of the Notice of Award of the <br />Contract, the Bidder to whom the Contract is awarded shall execute and deliver <br />two (2) original Contracts to the Owner, together with a Public Construction Bond <br />for 100 percent of the Bid in the forms set forth in the Contract Documents and <br />general Conditions; and all required insurance certificates, before the Contract <br />will be executed by the Owner. <br />I. Failure upon the part of the Bidder to whom the Contract has been awarded to <br />execute and deliver the Contract, a Public Construction Bond and required <br />insurance in the manner and within the time provided shall be just cause for <br />cancellation of the award. It is understood and agreed by said Bidder, that if the <br />award is cancelled for the above persons, the certified check or Bid Bond shall <br />become the property of the Owner, not as a penalty, but as liquidated damages. <br />00100-7 <br />
