1.16 PUBLIC CONSTRUCTION BOND
<br />The successful Bidder as Contractor shall furnish the County immediately upon execution
<br />of the Contract a Public Construction Bond in an amount equal to 100 percent of the
<br />contract price in the form provided in the Contract Documents. The Surety shall be
<br />authorized to issue surety bonds in Florida and be included in the most recent United
<br />States Department of Treasury List of Acceptable Sureties. The successful Bidder shall
<br />require the attorney-in-fact, who executed the Public Construction Bond, to affix to each
<br />a current certified copy of their Power of Attorney, reflecting such person's authority as
<br />Power of Attorney in the State of Florida. Further, at the time of execution of the
<br />Contract, the successful Bidder shall provide a copy of the Surety's current valid
<br />Certificate of Authority issued by the United States Department of the Treasury under 31
<br />United States Code sections 9304-9308. The Contractor shall provide a Public
<br />Construction Bond in conformance with Fla. Stat. 255.05(3).
<br />1.17 PUBLIC DISCLOSURE STATEMENT
<br />Any entity entering into a contract with Indian River County as Owner shall disclose any
<br />relationship that may exist between the contracting entity and an Indian River County
<br />Commissioner or Indian River County employee. The relationship with either must be
<br />disclosed as follows: Father, mother, son, daughter, brother, sister, uncle, aunt, first
<br />cousin, nephew, niece, husband, wife, father-in-law, mother-in-law, daughter-in-law, ron-
<br />in -law, brother-in-law, sister-in-law, stepfather, stepmother, stepson, stepdaughter,
<br />stepbrother, half brother, half sister, grandparent, or grandchild. The term "affiliate"
<br />includes those officers, directors, executives, partners, shareholders, employees,
<br />members, and agents who are active in the management of the entity.
<br />1.18 FLORIDA PRODUCED LUMBER
<br />The selected Bidder as Contractor agrees to comply with the provisions of Section
<br />255.20, Florida Statutes, as such statute may be amended from time to time, wherein
<br />Indian River County as Owner must specify lumber, timber and other forest products
<br />produced and manufactured in Florida whenever such products are available and their
<br />price, fitness and quality are equal.
<br />1.19 TRENCH SAFETY
<br />Florida Statutes Section 553.60 through 553.64, known as the "Trench Safety Act"
<br />requires all contractors engaged by Indian River County, Florida to comply with
<br />Occupational Safety and Health Administration's excavation safety standard, found in 29
<br />C.F.R. s. 1926.650 Subpart P. All prospective subcontractors are required to sign a
<br />Trench Safety Act Compliance Statement and provide compliance cost information where
<br />indicated. The costs for complying with the Trench Safety Act must be incorporated into
<br />the Bid.
