COUNTRYSIDE PHASE IV REPORT <br />Chairman Bird requested that Administrator Chandler give the <br />Board his report before this is opened to the public for discus- <br />sion. The Chairman complimented the job done by the Administra- <br />tor along with staff in preparing the voluminous report supplied <br />to the Board. He then requested that everyone who wished to <br />speak be as brief as possible and act like ladies and gentlemen. <br />Administrator Chandler went over the summation of his report <br />to the Board in considerable detail, as follows: <br />TO: Board of County Commissioners DATE: May 3, 1991 FILE: <br />SUBJECT: <br />FRO • James E. Chandler REFERENCES: <br />County Administrator <br />As requested by the Board of County Commissioners (BCC), at the March 19, <br />1991 meeting, I have conducted a thorough review and analysis of the <br />Countryside Phase IV -water and sewer franchise from 1980 to date. In the <br />process I reviewed a considerable number of documents, met with staff on <br />numerous occasions, and met with Countryside representatives twice. <br />Attached is a chronology and list of documents reviewed (2 - 12)a. -Although <br />to varying degrees each of the documents relates to the matter in question, <br />I have attached to this report only copies of those considered most pertinent <br />to the primary issues. The total file is available to anyone who may be <br />interested. Also attached is the correspondence received from Mr. Edson <br />Nelson, --President, Countryside North Homeowner's Association, Inc. (192 - <br />242). <br />The mobile home park in question, over the years has been referred to as <br />Village Green West, Phase IV; Village Green South, Phase IV; and <br />Countryside North, Phase IV (1) . <br />There have been a -number of questions raised by the Association that will be <br />addressed in this report. However, it appears the majority fall within three <br />major areas: 1) County administration of the 1980 franchise and collection of <br />prescribed fees; 2) vesting under the original 1980 franchise; and 3) - f <br />initial impact fees payments from the developer pursuant to the 1985 <br />agreement. <br />Franchise Administration: 1980 - 1985 <br />The Village Green Phase IV Water and Sewer System Franchise was adopted <br />by Resolution 80-88 (32 - 50) on September 10, 1980. Referenced in the <br />franchise are ordinances 80-21 (18 - 26) -and 80-22 (27 - 31) which delineate <br />the fee structures in affect at the time. Section XV of the franchise <br />prescribed various fees that were to. be paid by the developer, <br />Florida -Atlantic Associates. Although the language in this section is <br />somewhat vague and refers to water, both ordinances and correspondence <br />relate to water and sewer.
