GC 6 MATERIALS, LABOR, EQUIPMENT. <br /> Unless otherwise stipulated, the Contractor shall provide and pay for all materials, labor, tools, <br /> equipment, services, transportation and other facilities necessary for the execution and completion of the <br /> work. Unless otherwise specified, all materials incorporated in the permanent work shall be new and both <br /> workmanship and materials shall be of good quality. The Contractor shall, if required, furnish satisfactory <br /> evidence as to the kind and quality of materials. <br /> GC 7 QUALITY ASSURANCE <br /> Contractor shall develop, implement and maintain a plan for the work which quality assurance and <br /> management and control of the construction services. Contractor shall maintain an adequate inspection <br /> system and perform such inspections as will assure that the work performed conforms to the requirement of <br /> the Contract Documents. <br /> CG 7 PERMITS AND FEES. <br /> All Permits or licenses necessary for the performance of the work or required by law or ordinance, <br /> including Building permits, shall be secured, maintained, and paid for by the Contractor, unless otherwise <br /> provided in the Special Terms. Contractor shall be responsible for all governmental fees, including but not <br /> limited to utility fees and connection fees. Owner shall be responsible for obtaining any necessary easements. <br /> For construction of a building, Owner shall be responsible for all County Construction Services plan and <br /> permit review fees <br /> GC 8 PROJECT MANAGER. <br /> The Contractor shall keep during the term of this Agreement a competent Project Manager and any <br /> necessary assistants, all satisfactory to the Engineer and Owner. The Contractor shall advise the Engineer, in <br /> writing, within ten (10) days after the date of Owner's issuance of a Notice to Proceed, the name and local <br /> address of the Project Manager who will be in charge of the project, together with amount of his authority to <br /> represent the Contractor, along with the Project Manager's cell phone number. The Owner and Engineer shall <br /> be able to reach the Project Manager at his cell phone number at all working hours. The Project Manager <br /> shall represent the Contractor in his absence and all directions given to him shall be binding as if given to the <br /> Contractor. Important directions shall be confirmed on written request in each case. The Contractor shall give <br /> sufficient superintendence to the work using his best skill and attention. If the Contractor, in the course of the <br /> work finds any discrepancy between the plans and the physical conditions of the locality, or any errors or <br /> omissions in plans or in the layout as given by survey points and instructions, he shall immediately inform the <br /> Engineer and the Owner, in writing, and the Engineer will promptly verify the same. Any work done after such <br /> discovery, until authorized, will be done at the Contractor's risk. Neither party shall employ or hire any <br /> employee of the other party without his consent. At any time Owner may request and Contractor shall replace <br /> the individual performing as Project Manager with an individual acceptable to Owner. <br /> GC 9 SUBCONTRACTORS AND SUPPLIERS. <br /> M a) Within ten (10) days after the date of the Owner's issuance of a Notice to Proceed, the <br /> Contractor shall furnish to the Owner in writing the names of the persons or entities(including those who are <br /> to furnish materials or equipment fabricated to a special design) whom the Contractor will engage as sub- <br /> contractors or suppliers for the Project. The Contractor shall not contract with a proposed person or entity to <br /> whom the Owner has made reasonable and timely objection in writing. The Contractor understands and <br /> agrees that the Contractor alone is responsible to the Owner for all of the work under the Contract and that <br /> any review of Subcontractors, Sub-subcontractors or suppliers by the Owner or Engineer will not in any way <br /> make the Owner responsible to any Subcontractor or Sub-subcontractor or suppliers, nor will it make the <br /> Owner responsible for the actions or omissions of any Subcontractor or Sub-subcontractor or suppliers. <br /> b) By appropriate written agreement, the Contractor shall require each Subcontractor, to the <br /> extent of the Work to be performed by the Subcontractor, to be bound to the Contractor by terms of the <br /> Contract and Contract Documents, including but not limited to the insurance requirements for workers' <br /> compensation and general liability coverage. The Owner shall be named as an intended Third Party <br /> Beneficiary in all Subcontractor Agreements. Each subcontract agreement shall preserve and protect the <br /> rights of the Owner under the Contract Documents with respect to the work to be performed by the <br /> Subcontractor so that subcontracting thereof will not prejudice such rights, and shall allow to the <br /> Subcontractor, unless specifically provided otherwise in the subcontract agreement, the benefit of all rights, <br /> 30 <br />
