character and accessibility of the site, availability of facilities, location and character of existing work <br /> within or adjacent thereto, labor conditions, etc. The County shall make available to all prospective <br /> Bidders, prior to the receipt of bids, any available information that may be requested by Bidders. <br /> Any such data will be distributed to all prospective bidders as the best factual information available, <br /> without presumption of responsibility for its accuracy or for any conclusions that the bidder may <br /> draw there from. The Bidder shall accept the site or sites in their present condition. <br /> 4. INSPECTION OF FACILITIES <br /> It is the bidder's responsibility to become fully informed as to the nature and extent of the work <br /> required and its relation to any other work in the area, including possible interference from other site <br /> activities. Arrangements for bidder's inspection of facilities and/or activity schedules may be <br /> secured from the Project Engineer Michael D. Nixon, P.E. at (772) 226-1986. Failure to visually <br /> inspect the facilities shall be cause for rejection of your bid. <br /> 5. LEGAL REQUIREMENTS <br /> Federal, State, County and local laws, ordinances, rules and regulations that in any manner affect <br /> the items covered herein apply. Lack of knowledge by the bidder will in no way be a cause for relief <br /> from responsibility. <br /> (1) In compliance with Florida Statute (Section 287.087) attached form "Drug-Free <br /> Workplace Certification" should be fully executed and submitted with bid response. <br /> (2)The Uniform Commercial Code(Florida Statutes, Chapter 672)shall prevail as the basis <br /> for contractual obligations between the awarded contractor/vendor and the County for any <br /> terms and conditions not specifically stated in the Invitation for Bid. <br /> (3) The obligations of the County under this award are subject to the availability of funds <br /> lawfully appropriated for its purpose. <br /> (4) This Invitation for Bid shall be included and incorporated in the final award. The order of <br /> contractual precedence will be the purchase order or price agreement release, bid document <br /> (original Terms and Conditions), and response. Any and all legal action necessary to <br /> enforce the award will be held in the County and the contractual obligations will be <br /> interpreted according to the laws of Florida. <br /> 49 <br />
