Van Fleet Water Production Facility Improvements BVP 13-196 <br /> Combined Single Limit Each Accident <br /> These policies will provide that: <br /> 1) The insurer(s) waive their rights of subrogation in favor of the County, their officials, <br /> employees, agents and consultants for Workers' Compensation and General Liability. <br /> 2) The County, a political subdivision of the State of Florida, shall be named as an additional <br /> insured with respect to liability arising from the work performed for the County by the Contractor (as <br /> defined by the scope of this submittal and subsequent contract) for Automotive and General Liability <br /> policies of insurance. This should be stated on Certificate(s) of Insurance and subsequently endorsed <br /> into the policies. Renewal notices to be sent to the Procurement Division. <br /> 3) The Contractor shall not be given Notice to Proceed under this contract until it has obtained <br /> all the insurance required by the Contract Documents and such insurance has been approved by the <br /> County. The original insurance certificates shall be given to: <br /> Polk County, a political subdivision of the State of Florida <br /> 330 West Church Street <br /> Bartow, Florida 33830 <br /> The acceptable form of the certificate of insurance shall be the industry standard ACORD certificate. <br /> 6.3.2 Notwithstanding any other provision of these documents to the contrary, the Contractor shall not <br /> provide Builder's Risk or Architects' and Engineers' Professional Liability Insurance unless specially <br /> requested by the County. The County has Builder's Risk coverage and will provide the Contractor with <br /> appropriate Certificate of Insurance upon request. The County's Builder's Risk policy does not insure <br /> the Contractor's tools, machinery or equipment that is stored at the job site. If the Contractor is required <br /> to store tools, machinery or equipment at the job site, the Contractor should provide insurance in the <br /> form of an equipment floater for the Contractor's tools and equipment. The County should be named as <br /> an additional insured on the Contractor's policy, with an appropriate waiver of subrogation as to any <br /> claims the Contractor or the Contractor's insurer may have against the County arising from the storage of <br /> the Contractor's tools and equipment. <br /> 6.3.3 The Contractor shall not allow a subcontractor to work on a Project without either subcontractor <br /> carrying their own Workers' Compensation and Liability insurance or the Contractor covering the <br /> subcontractor under their policies. The policy is the same for each succeeding sub-tier contractor. The <br /> County may request proof of such coverage for any subcontractor at anytime during the Project. <br /> 6.3.4 Any additional insurance, if required,will be called out in the Supplementary Conditions. <br /> 6.4 Receipt and Application of Insurance Proceeds <br /> 6.4.1 Any insured loss under the policies of insurance required by this agreement will be adjusted with <br /> the County and made payable to the County as fiduciary for the insured as their interest may appear. The <br /> County shall account for all money received and shall distribute it in accordance with such agreement as <br /> the parties in interest may reach. If no other special agreement is reached, the damaged work shall be <br /> repaired or replaced; the money so received applied on account thereof; and the work and cost thereof <br /> covered by an appropriate change order or written amendment as determined by the County. <br /> 6.4.2 The County as fiduciary has the power to adjust and settle any loss with the insurers. If such <br /> objection is made, the County as fiduciary shall make settlement with the insurers in accordance with <br /> 67 <br />
