Van Fleet Water Production Facility Improvements BVP 13-196 <br /> 10) Calculation of Liquidated Damages <br /> The parties acknowledge that it would be difficult or impossible to accurately determine <br /> the amount of actual damages the County would or may incur as a consequence of the <br /> Contractor's failure to timely deliver the Project Work in accordance with the Contract <br /> Documents. Accordingly, in lieu of assessing actual damages if the Contractor fails to <br /> timely deliver Project Work,the parties confirm that: (i)the assessment of liquidated <br /> damages is reasonable and appropriate; (ii)the terms and the amount(s) of the liquidated <br /> damages stated below are reasonable; and (iii) the liquidated damages will be assessed as <br /> the County's remedy under such circumstances and not as a penalty. <br /> Inspection Services 8 hours per day @$100.00 per hour $ 800.00 <br /> Project Management 2 hours per day @ $150.00 per hour $ 300.00 <br /> Mileage 100 miles per day @ $0.55 per mile $ 55.00 <br /> Other Miscellaneous Project Expenses $ 45.00 <br /> Total Daily Liquidated Damages $1,200.00 <br /> Should the Contractor request and be granted additional time to reach Substantial <br /> Completion via change order(s), the last revised date shall be the date used to calculate <br /> the time for which liquidated damages will be assessed. <br /> 11) RFI Logs <br /> Contractor will generate and maintain a Request for Information (RFI) log on all RFIs <br /> submitted in order to ensure proper recording. The log should include the date that the <br /> RFI was issued, the RFI subject and matter,the Professional to which the RFI was <br /> submitted, the RFI resolution, and the date the RFI answer was received. <br /> 12) Contract Time <br /> Contractor shall provide a schedule of the major project milestones. Schedule shall be <br /> provided in Microsoft Project format. The contract time for this project will be defined as <br /> the total number of calendar days from Notice to Proceed to achieve Substantial <br /> Completion. Allow 60 calendar days from Substantial Completion to Final Completion. <br /> Unless otherwise specified in the contract documents, the warranty period for completed <br /> work shall be extended to one year from the approval of final application of payment and <br /> acceptance by the County and is changed from substantial completion as stated in the <br /> General Conditions. <br /> 13) Project Sign <br /> Contractor shall provide a project sign per the attached details. <br /> 14) Conflict of Interest <br /> 95 <br />
