Van Fleet Water Production Facility Improvements BVP 13-196 <br /> A person or affiliate who has been placed on the convicted vendor list following a conviction for <br /> a public entity crime may not submit a proposal on a contract or provide any goods or services to <br /> a public entity, may not submit a proposal on a contract with a public entity for the construction <br /> or repair of a public building or public,work, may not submit proposals on leases of real property <br /> to a public entity, may not be awarded or perform work as a contractor, supplier, subcontractor, <br /> or consultant under a contract with any public entity, and may not transact business with any <br /> public entity in excess of the threshold amount provided in Section 287.017, for CATEGORY <br /> TWO for a period of 36 months from the date of being placed on the convicted vendor list. <br /> [(Florida Statutes Section 287.012(11)(16), Section 287.058, Section 287.133, paragraph (2)(a)] <br /> By submitting this proposal, Contractor hereby certifies that it is in compliance with said statute. <br /> 20) Preference for Drug-Free Workplace <br /> Whenever two or more submittals which are equal with respect to price, quality and service are <br /> received; preference shall be given to a submittal received from a business that certifies that it <br /> has implemented a drug-free workplace program in accordance with Florida Statutes, Section <br /> 287.087. If there are two or more submittals that are equal and also certifies as a drug free <br /> workplace,then the tie shall be broken as per the Polk County Procurement Procedures. <br /> 21 ) Requirement to list Subcontractors <br /> The Contractor must list the subcontractors, other persons or entities (including those who are to <br /> furnish materials or equipment fabricated to a special design) and the associated costs for those <br /> subcontractors that are noted as a key component of the Work. During the execution of the <br /> Contract the successful Contractor shall be as fully responsible to the County for the acts and <br /> omissions of their subcontractors and of persons either directly or indirectly employed by them as <br /> they are for the acts and omissions of persons directly employed by them. The successful <br /> Contractor shall cause appropriate provisions to be inserted in all subcontracts relative to the <br /> Work to require compliance by each subcontractor with the applicable provisions of the Contract. <br /> Nothing contained in the Contract shall create any contractual relation between any subcontractor <br /> and the County. <br /> 22 ) Women/Minority Business Enterprise Outreach (WMBE's) <br /> The County hereby notifies all Contractors that W/MBE's are to be afforded a full opportunity to <br /> participate in any solicitation by the County and will not be subject to discrimination on the basis <br /> of race, color, sex or national origin. The County asks that Contractors make good faith efforts to <br /> use qualified W/MBE subcontractors in preparing their Submittals. The W/MBE's must be <br /> identified as such on the subcontractors list. Contractors are encouraged to contact the Supplier <br /> Diversity Office, at (863) 534-5959 or (863) 534-5901for assistance. If a Contractor makes a <br /> good faith effort to find and utilize qualified W/MBE subcontractors, but is not successful, they <br /> have fulfilled the Good Faith Effort required. Good Faith Effort shall be described as the effort <br /> put forth by Contractors on construction proposals to solicit prices from women/ minority <br /> contractors. <br /> 23 ) Equal Opportunity for Contractors and Subcontractors <br /> 97 <br />
