B. This project will be completed in three phases <br />Phase L Includes the following work to the "Little League Field", removal of a "lip" at <br />the edge of the infield and existing grass, and filling in a dip in the outfield. Fill-in will be <br />with 4" thick clay material and will create an extended infield area. <br />Phase I will begin on December 18, 2013 and will be complete no later than January <br />8, 2014. (20 calendar days) (Work and time suspended from January 9, 2014 <br />through January 26, 2014) <br />Phase 11: Includes all work on the "Football Field and "Senior Softball Field" and the <br />installation of the new light poles along the drive. <br />This work will commence on January 27, 2014 and will be ready for final completion <br />August 27, 2014. (210 calendar days.) <br />Phase III: Includes the work on the "Little League Field" including removal of existing <br />outfield fence. <br />Phase III work will commence on June 30, 2014 and shall be finished and ready for <br />play on October 31, 2014. (122 calendar days) <br />4.03 Liquidated Damages <br />A. CONTRACTOR and OWNER recognize that time is of the essence of this Agreement and <br />that OWNER will suffer financial loss if the Work is not completed within ;the times <br />specified in paragraph 4.02 above, plus any extensions thereof allowed in accordance with <br />Article 12 of the General Conditions. Liquidated damages will commence for thisl, portion of <br />work. The parties also recognize the delays, expense, and difficulties involved in proving in <br />a legal proceeding the actual loss suffered by OWNER if the Work is not completed on <br />time. Accordingly, instead of requiring any such proof, OWNER and CONTRACTOR <br />agree that as liquidated damages for delay (but not as a penalty), CONTRACTOR shall <br />pay OWNER $278.00 for each calendar day that expires after the time specified in <br />paragraph 4.02. <br />ARTICLE 5 - CONTRACT PRICE <br />5.01 OWNER shall pay CONTRACTOR for completion of the Work in accordance with the <br />Contract Documents, an amount in current funds equal to the sum of the amounts <br />determined pursuant to paragraph 5.01.A and summarized in paragraph 5.01.13, below: <br />A.
