code to allow a 1-time, 2-year extension to a sidewalk contract if a contract was in effect prior to: <br />30, 2012. The time has now come where one of these developers is approaching the end of its 1 <br />2-year extension for these sidewalks, and because the market is not yet at the point where to <br />being sold and built on, the developer Is requesting that the Board revisit this portion of the cc <br />consider granting a second 2-year extension so that the developers are not forced to construct <br />sidewalk segments now, knowing full well that when the tots are sold and later a residence constr, <br />the construction equipment will destroy the sidewalks and the developer will be required to <br />construct them before a certificate of occupancy will be issued, thus paying for the same constr <br />twice. <br />RECOMMENDATION: <br />June <br />are <br />a to <br />again <br />1. Staff has no objection to the Board holding a public hearing to consider amending the code to <br />provide that an additional 2 -year extension be available to the developers who are operating <br />under the sidewalk bonding -out regulations that were in effect prior to 2009, and who have a <br />sidewalk contract currently in effect prior to June 30, 2012. <br />2. For the sidewalk contracts for the above-named subdivisions which will be expiring prior o the <br />holding of a public hearing and the possible adoption of an amendment, allow a grace period for <br />the developers from having to construct the sidewalks while the Board considers the adoption <br />of an ordinance amendment and, in the event the Board does not adopt an ordirlance <br />amendment, give the developers 90 days from the date of the public hearing to complete the <br />sidewalk construction so long as the security, if in the form of a letter of credit, is approp lately <br />extended. is is noted that no security will be expiring prior to January, 2014, <br />FUNDING: <br />The only cost associated with this issue is the cost of advertising the notice of public hearing. The ost is <br />estimated to be approximately $130.00. Funds are available from General Fund/County Attorney legal <br />Account No. 00110214-033110. <br />REQUESTED ACTION: <br />I. <br />2. <br />nhm <br />Authorize staff to proceed with advertising for the Board to hold a public hearing to consider <br />amending portions of Chapter 913 with respect to sidewalk extensions on subdivisions that <br />were platted prior to 2009; and <br />Allow a grace period for the developers from having to construct the sidewalks while the Board <br />considers the adoption of an ordinance amendment to provide for an additional -year <br />extension to the existing sidewalk contracts and, in the event the Board does not adopt an <br />ordinance amendment, allow the developers a 90 -day grace period from the date of the public <br />hearing to complete the sidewalk construction so long as the security, if in the form of a letter of <br />credit, is appropriately extended. If the Board does not adopt such an ordinance amen Jiment <br />and the developer does not complete the sidewalk construction within the 90 -day grace eriod, <br />authorize staff to proceed to call the security due to the contract being in default. <br />2 <br />x <br />174 <br />
