• File I`unofficial results with the Department of State—no later than noon of the 3`d day after <br /> any primary election and no later than noon on the 4th day after any general election or other <br /> election. Such returns shall in clued the canvass of all ballots required by Section 102.141 (2)FS. <br /> • In the counties that transmit precinct results via dedicated teleprocessing lines to a central <br /> �— location for compilation, the board must conduct a race by race comparison by precinct of the <br /> printed results from the polling places to a tabulation report produced at the central location from <br /> the original transmitted data. This must be completed prior to submission of final results. Rule <br /> I 5-2.016 FAC. <br /> Suggestion—Since all proceedings of the canvassing board must be publicly noticed,prepare the legal <br /> notice to cover anypossibility in the event the board needs additional time to canvass and there is not <br /> time to advertise any change in the schedule. <br /> Recount(if indicated)—Sections 102.141(7)and 102.166,FS; Rule 15-2.031,(Recount Procedures) <br /> and 1S-2.027,FAC (Standards for Determining Voter's Choice on a Ballot). <br /> • If a machine recount is triggered pursuant to Section 102.141(7), FS: <br /> o Order a recount before conducting recount(in the case of a federal, state, or multicounty <br /> race, the Secretary of State issues the order). <br /> o Do not recount if the candidate(s)defeated or eliminated from contention by one-quarter <br /> or one percent or fewer of the votes cast for the office request in writing that a recount <br /> not be done. <br /> o Conduct logic and accuracy test BEFORE re-running any ballots back through the <br /> equipment. <br /> o Run the ballots back through the tabulating equipment. <br /> o In a recount where touch screen devices for voters with disabilities were used, examine <br /> the counters on the touch screen devices to ensure that the returns,when combined with <br /> all other returns, equal the overall election return. <br /> Make a true duplicate of any physically damaged ballot that cannot be counted by the tabulating <br /> equipment BEFORE processing(follow procedures in Section 101.5614(5),FS.) <br /> Suggestion—If a recount is required, the board should attempt to contact by telephone those candidates <br /> whose race is being recounted. A recount is not required if the losing candidate requests in writing that <br /> a recount not be made. Section 102.141(7), FS. <br /> o Submit a second set of unofficial returns to the Department of State by 3 p.m. of the fifth <br /> day following any primary election or by 3 p.m. the ninth day following any general <br /> election. (Unless the recount was for a local office only). Section 102.141(7)(c)FS. <br /> • If the results of the machine recount trigger a manual recount pursuant to Section 102.166 FS: <br /> o Order recount before conducting manual recount(in the case of a federal, state, or <br /> multicounty race,the Secretary of State issues the order). <br /> o • Recount only overvotes and undervotes. <br /> o Do not recount if the number of over votes and under votes,is fewer than the <br /> number of votes needed to change the outcome of the election or if the candidate(s) <br /> defeated or eliminated from contention by one-quarter of one percent or fewer of <br /> the votes cast for the office request in writing that a recount not be done. <br /> o Open manual recount proceedings must to the public. <br /> o Use standards for determining"voter intent"as set forth in Rule I S-2.027,FAC. <br /> Suggestion—If a recount is required, the board should attempt to contact by telephone those candidates <br /> whose race is being recounted.
