r <br /> 4. The Respondent, Gwinn, Inc. d/b/a Sunset Cafe and Vero Beach Shopping <br /> Center Associates Limited Partnership made payment pursuant to the <br /> Environmental Control Hearing Board Order and lien on file, case number 488- <br /> 11, in the amount of One Thousand Dollars ($1,000.00). Accordingly, Satisfaction <br /> and Release of Lien was prepared and recorded and this file has been closed. <br /> The Lien was filed in the Public Records of Indian River County. Case No 488-11 <br /> (Fine $1,000 Paid in Full) <br /> 5. The Respondent, O & N Investments, Inc. with a fictitious business name of <br /> "Country Trailer Park" and the Health Department entered into a Stipulation <br /> dated January 28, 2011, which was approved by the hearing board via Order <br /> adopting the Stipulation dated February 18, 2011. Upon an inspection, and <br /> subsequent re-inspections of the trailer park starting on January 19, 2012, <br /> Respondent was found to be out of compliance with the Stipulation. During a <br /> routine inspection, the Health Department found the Respondent out of <br /> compliance with paragraphs 3, 6 and 9 of the Stipulation. Respondent achieved <br /> compliance May 9, 2012 upon re-inspection by the Health Department; however, <br /> a sanitary nuisance did occur and the Stipulation was violated. A fine of Four <br /> Thousand Five Hundred Dollars ($4,500.00) was recommended when the matter <br /> was brought back before the June 2012 hearing board meeting. Respondent did <br /> appear and argued its case; however, the hearing board did go ahead and <br /> entered the fine. Case 485-11. <br /> 6. A Satisfaction and Release of Lien was recorded in the case of Respondents <br /> William R. Buchanan and Rachel Buchanan owners of real property located at <br /> 861 46th Avenue, Vero Beach, Florida. Buyer's Title Inc Escrow paid the Two <br /> Thousand Five Hundred Dollar ($2,500.00) fine levied. Case No. 468-09 (Fine <br /> $2,500 Paid in Full) <br /> 7. Lamb's Enterprises, Inc. owned and operated by Gladys B. Lamb. A civil penalty <br /> of one thousand eight hundred dollars ($1,800.00) was levied for the violations. <br /> The parties entered into a six (6) month payment plan and the first installment <br /> payment of $300.00 was paid in March. Respondents failed to make April <br /> payment as agreed so staff contacted Respondent via phone and certified mail. <br /> Case No. 494-11. (Partial Fine $1,200 Collected) <br /> 8. Environmental Health staff continued archiving case files and completed work on <br /> a case and fine tracking system. <br /> 9.
