d. Bush hog, on a quarterly basis,the approximately fourteen(14) acre site immediately east <br /> of the Licensed Property; <br /> e. Maintain the single family residence and detached garage in a safe and attractive <br /> condition, and protect the residence and garage from deterioration from the elements, <br /> insects and pests, and other such conditions; <br /> f. Arrange and pay for(including deposits, if any) all utilities, including, without limitation, <br /> water, sewer, electricity, telephone, cable television, etc. <br /> g. Commit no act or omission which would result in waste, damage or destruction to any <br /> portion of the Licensed Property; <br /> h. Commit no act or omission which would result in a mortgage, encumbrance, lien or other <br /> right, title or interest in the Licensed Property being acquired by any third party; <br /> i. Commit no act or omission which would constitute a violation of any applicable local, <br /> state or federal law, or a nuisance or annoyance to surrounding properties or owners or <br /> occupants of surrounding properties; and <br /> j. Advise Licensor immediately of any security issues, damage to the Licensed Property, or <br /> any other events or conditions which could result in damage to the property, liability to <br /> Licensor, or any other such adverse impact to the Licensed Property or to Licensor. <br /> 5. Licensor's Duties. Licensor shall: <br /> a. Repair the Licensed Property, to the extent that the need for repair is not caused by <br /> Licensee's negligence, intentional misconduct or violation of this License Agreement or <br /> applicable law; and <br /> b. Commit no act or omission which would constitute a violation of any applicable local, <br /> state or federal law. <br /> 6. License Fee. Provided Licensee performs all terms and conditions of this License <br /> Agreement, Licensee shall not be required to pay a license fee. <br /> 7. Improvements. Licensee shall make no alterations or improvements to the Licensed Property <br /> without the express written approval of Licensor, which may be withheld in the sole and <br /> absolute discretion of Licensor. The parties acknowledge that Licensee desires to paint the <br /> interior, remove the carpeting and refinish wood floors of the residence. Licensee shall not <br /> perform any of this work until after receiving express written approval of Licensor, following <br /> Licensor's consultation with the Florida Communities Trust("FCT"). <br /> 8. Historic Preservation. Licensee acknowledges that Licensor acquired the Licensed Property <br /> in part through a grant from FCT, which grant was made in light of the historical significance <br /> Page 2 of 4 <br /> 28 <br />
