Polackwich, Sr., County ACS` <br /> DATE: May 22, 2013 <br /> SUBJECT: Public Hearing - Proposed Ordinance Allowing Additional Homestead Exemption <br /> for Qualifying Senior Citizens (Pursuant to Amendment 11) <br /> BACKGROUND. <br /> In the November 6, 2012 general election, 61.26% of Florida voters approved Amendment 11, <br /> which authorizes counties to allow an additional property tax homestead exemption for senior <br /> citizens who (1) hold title to homestead property having a just value of less than $250,000, (2) have <br /> maintained their residence on the property for at least 25 years, (3) have attained the age of 65, and <br /> (4) whose household income does not exceed an indexed amount which is adjusted annually <br /> (currently $27,590). <br /> The Florida Legislature implemented Amendment 11 by revising §196.075, Florida Statutes, to <br /> provide that the additional exemption must be created by an ordinance adopted by a"super majority" <br /> (defined as a majority plus one) of the Board of County Commissioners. If adopted, the exemption <br /> applies only to taxes levied by the County, including its dependent special districts and MSTUs. For <br /> the exemption to apply in the 2014 tax year, it must be adopted prior to December 1, 2013. <br /> On May 7, 2013, the Board instructed the County Attorney to bring forward a proposed ordinance <br /> creating an additional exemption in the amount of $25,000 for public hearing and possible final <br /> adoption—which is the purpose of this agenda item.
