Rison c'(z- <br />Staff Planner, Current Development <br />DATE: May 14, 1991 <br />SUBJECT:_ CENTRAL ASSEMBLY OF GOD, INC.'S REQUEST FOR SPECIAL <br />EXCEPTION USE APPROVAL FOR AN EXISTING PRIMARY SCHOOL <br />' SP -MI -91-03-18 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of May 28, 1991. <br />PROPOSED DEVELOPMENT AND LOCATION: <br />John Dean, on behalf of Central Assembly of God, Inc., is <br />requesting special exception use approval for existing primary <br />school facilities located at 6767 20th Street. The applicant is <br />seeking formal approval to legalize the primary school use which <br />has been operating on the site for a period of over four (4) years. <br />Although no building permits or certificates of occupancy will need <br />to be issued for the existing facilities, compliance with any <br />approval conditions can be ensured via code enforcement action. <br />At its May 9, 1991 meeting, the Planning and Zoning Commission <br />unanimously (7-0) granted administrative use approval (final <br />action) for a day care center use for the site and conditionally <br />approved the site plan with the conditions recommended by staff. <br />The Planning and Zoning Commission also unanimously recommended <br />that the Board of County Commissioners grant special exception use <br />approval for the primary school. Final action on the special <br />exception request for the school must now be taken by the Board of <br />County Commissioners. <br />Special exception uses are those types of uses that would not <br />generally be appropriate throughout a particular zoning district. <br />However, when special exception uses are carefully controlled as to <br />number, area, location, and/or relationship to the vicinity, such <br />uses would not adversely impact the public health, safety, comfort, <br />good order, appearance, convenience, morals and general welfare and <br />as such would be compatible with permitted uses within the <br />particular zoning district. In granting any special exception, the <br />Board may prescribe appropriate special conditions and safeguards <br />to ensure that the use is compatible with surrounding uses in the <br />district. <br />21-1 -1P.�,-1 <br />uu <br />
